Legal Requirements for Marrying in Australia
- Before you may marry, the law requires that you sign and lodge with me the Notice of Intended Marriage. This form must be submitted to me a minimum of one calendar month and one day prior to the wedding. You can submit your Notice in person, via fax or mail, but you must bring the original Notice with you when you meet with me. The NIM form will remain active for 18 calendar months from the date of submission.
- You must be over 18 years of age to marry in Australia
- If you are Australian born you must show your birth certificate in English. If born outside Australia you are required to show your birth certificate or passport from your country of birth.
- If either of you have previously been married you will have to produce your Divorce Decree Absolute papers and/or if either of your spouses are deceased, you must produce the Death Certificate.
- On the day of your marriage you must have two witnesses over the age of 18. if necessary I can arrange this.
I have lost my personal papers, what should I do?
If you have lost your birth certificate, you will need to obtain a new one, by applying to Births, Deaths and Marriages. This can be done in person, on the internet or by mail. For divorce papers, you will need to apply to the Family Court where your divorce was granted.
Can we right our own vows?
Definitely, I believe that vows that have been personally written are a special, unique gift to your partner. However certain words must be used.
Can we write the whole ceremony?
Yes, however the are certain legal requirements that must be met. These include, the asking of a question in which you give you consent to be married. The vows- a promise for the future, and the Monitum.
If we bring all the documentation, can we get married today or tomorrow?
No. To abide with Australian laws you must have all your documentation when you fill out the Notice of Intention to Marry at least 1 month prior to the marriage, but not longer than 18 months before. In very special circumstances, Births, Deaths and Marriages may consent to a shortening of time.
Is the certificate we get on the day sufficient as proof of marriage?
The presentation certificate you receive on the day, proves that a marriage took place. However to change your name on bank accounts, drivers licence, passport etc, you will require the official marriage certificate. This is obtained from Births, Deaths and Marriages. Fee applies.
Do I have to be given away?
This segment of the ceremony is entirely optional. Some brides prefer to be presented.
